SECTION 149 PLANNING CERTIFICATE

A 149 Certificate is a planning certificate under Section 149 of the Environmental Planning and Assessment Act 1979.
These certificates give information on the development potential of a parcel of land including the planning restrictions that
apply to the land on the date the certificate is issued. There are two types of 149 Certificates, 149(2) and 149(5).
What is the difference?
A 149(2) Certificate provides you with information such as the zone, whether the land is affected by any Draft Local
Environmental Plans and Development Control Plans, and whether the land has restrictions on development.
A 149(2) & (5) Certificate provides you with all of the above information plus additional information such as easements,
unhealthy building land, outstanding health & building notices and other matters which includes other information
Council feels is relevant to the land.
Why do I need a 149 Certificate?
When land is bought or sold the Conveyancing Act 1919 requires a 149 Planning Certificate to be attached to the
contract of sale. It may also help an existing owner to decide about the uses of their land.
Is there a fee involved?
A 149(2) Certificate costs $40.00 and a 149(5) Certificate costs $60.00. 149 Certificates must be paid for upfront.
How do I apply for a 149 Certificate?
You need to complete an application form which is available for downloading below or by contacting Council on the
phone number below and Council will mail or fax one out to you.

Your application should be accompanied by a cheque or you can make your payment at Inverell Shire Council’s
Administration Building, 144 Otho Street, Inverell.
How do I apply for a drainage diagram on the 149 Application?
Tick appropriate box on the 149 Application and pay the $15.00 fee.
How long do they take to process?
Council usually requires 5 working days to process your application.
What if my application is urgent? Can I pay an urgency fee?
Council does not have an urgency fee. If your application is urgent you are requested to telephone Council’s
Planning & Development Department on 02 6728 8202 to make arrangements.

603 RATING CERTIFICATE

A 603 Rating Certificate details the current outstanding rates for a property, along with any other property related
outstanding debts. The cost of a 603 Rating Certificate is $55.00, which may be applied for by contacting Council's
Rates Department or alternativly downloading the file below on (02) 67288 258.

SECTION 149D BUILDING CERTIFICATE
<hidden text>
A Building Certificate is a certificate that is issued by Council which states that Council will not take any action
under the Environmental Planning & Assessment Act 1979 or the Local Government Act 1993, to order or take
proceedings for an order to have the building (covered by the certificate) to be demolished, altered, added to or
rebuilt, or to take proceedings in relation to any encroachment by the building onto land under the control of
Council, for a period of seven (7) years. A certificate is usually applied for when selling houses or other property.
How is the building certificate different from the other 149 Certificate?
Section 149(2) and Section 149(5) certificates apply to the land specified whereas Section 149(b) and (d) certificates
apply to the structures on the land.
Do I have to provide a survey?
A current Identification survey from a registered surveyor is required (or a certified copy of the same). A current survey
means one that is in metric and is a true representation of all improvements on the land.
Is the owner's consent required?
To be able to apply for a Section 149(b)(d) Building Certificate you must have the owner's consent, be the owner's
solicitor/agent, be a purchaser who has entered into a contract to purchase the property, purchaser's solicitor/agent
or a public authority that has notified the owner of its intention to apply for the certificate.
How do I apply for a building certificate?
A form is available on this website or you can call Council and arrange for a copy to be mailed to you or you may
collect one from Council’s Administration Building, 144 Otho Street, Inverell.
149 BUILDING CERTIFICATE APPLICATION
Council is required to inspect the property, therefore details for access arrangements must be completed on the
application form.
How much does a building certificate cost?
As of 1st July 2005:
Dwelling (Class 1 or Class 10) (each)<hidden text><hidden text><h>$ 210.00

SECTION 735A NOTICES CERTIFICATE
<hidden text>
Local Government Act (Notices) Certificates are issued under Section 735A of the Local Government Act and are
generally issued after a check as to whether any notices have been issued for the subject property.
These notices are usually applied for when a property is being purchased or sold.
How do I apply for a 735A Certificate?
You need to complete an application form which is available for downloading below or by contacting us on the phone
number below and we will mail or fax one out to you.
Your application should be accompanied by a cheque or you can make your payment at Inverell Shire Council’s
Administration Building, 144 Otho Street, Inverell.
Is there a fee involved?
A fee of $40.00 is required. All must be paid for up front.
How long do they take to process?
